Ron is going to be in Superior Court on January 19th. I guarantee one thing. He knows the helmet law better than the cop did on the day he was ticketed. Please cheer him on folks! Moral support and encouragement means a lot. May JUSTICE and FAIRNESS prevail !

My 2 week "house arrest" is over....
It's after 1 pm and it's Friday--and no call from the courts-- the 2 weeks are up-so it's very safe to assume I aint going to be on trial this session for my helmet ticket. Will find out Monday when I visit the courthouse--if they moved me to the next session--or dismissed it --as they did my previous helmet ticket. I feel it will most likely be the latter--though if they really wanted to harrass me and muscle me around some more they could possibly reschedule me for next session and run me through the mill again for another 2 weeks and make me stay close by the courthouse for another 2 weeks just to show me they can screw with me even more. I wouldn't put it past them to pull crap like that. But---they best beware--you can only mess around with a rattlesnake so many times before you get badly bit. Will post something on Monday after I get home from the courthouse as to what happens next. The case may be dismissed, we will see,--but I assure you that the fight is just beginning.
Ron goes to trial January 19, 2010
Ron is in court today. There is no way of knowing if he will be allowed to go to trial today or if they are just jerking him around like they did with him last time, and like they did with Matt, and like they did with me.
Superior Court update.
I was not allowed to have my day in court today... yep the DA is muscling me around again. This seems to be the norm here in N.C. Superior Courts than the exception....they must have all gotten the same intructions from our government who attempts to police us with a "sit down and shut up" nazi style type control. I am on call for the next 2 weeks---which means I must remain in close proximity of the courthouse, so if they should decide to give me my trial--they can call me and I can get there soon and have my trial when and if they think it's best for them. There were 48 people on the trial list this morning--and 9 days during this Superior Court session. Most trials take atleast half a day--some much longer. Anyone wanna bet me they don't dismiss this trial like they did my last one and also the one they dismissed with Matt just last week? We as bikers---should learn from this and use this against them. Get people together in groups and go out for a nice ride with your ballcap helmet on, or maybe your scarf helmet or CD helmet, whatever is your favorite FMVSS 218 compliant helmet. When you all get tickets --don't pay the fine. Take it all the way to the Superior Court and while waiting to get there meet as a group together a few times before trial and get your defense papers ready which you can get from Jan or me or most any BOLT member if you just ask us. We want to repeal this unconstitutional law, we believe you also want to repeal it and we have found the way, the BOLT way, and we need your help to accomplish this and in return we will help you with the defense papers. You know--it's actually kinda fun sticking it to the man when they are so wrong about the law and we are so right about it and they get all arrogant and huffy and puffy and bark orders in your face out on the streets...and then you get to go to court and shove their ticket where the sun don't shine on them. Even a dismissal is a win for us--and a loss for them. More updates when I get something.
Truth in Courtroom Scheduling
Already, the State of NC has once again proven there is no justice or fairness in the judicial process in North Carolina. It is medieval that they order someone to stay close to home and close to the phone for two weeks in the event that the state wants to prosecute a trial on just a few hours notice.
Under these circumstances, it begins punishment of those who are innocent until proven guilty, and makes it nearly impossible to secure expert witnesses for the defense.
The judicial branch will not change itself. We need to have the NC General Assembly introduce a 'TRUTH IN COURTROOM SCHEDULING" bill.
Ron's Superior Court day reset by DA for March 15th.
After being on call for the past 2 weeks during this recent Superior Court session, which ended on 29 Jan 2010--I never got called in for my trial on my ballcap helmet ticket I received back on 2 July 2009. I found out today they have rescheduled me now for the next session which begins 15th March..and once again I will be on another 2 week call, having to stay close to the courthouse in case they call me in for trial. They may believe they are wearing me down by muscling me with this game of theirs in hopes I will go out and buy a helmet that "looks" like it "might" be FMVSS 218 compliant through the imagination of some cop on what he thinks a helmet might have to look like in order to be 218 compliant beased on design, looks and his own personal subjective opinion. Problem is--I can ask 10 cops what a compliant helmet is--and get 10 different answers. No--they aint wearing me down--they just pissing me off more and those of you who know me--I aint nice to be around when I get pissed off cause I bite. If they don't get me in this next time and let me have my trial--then they also will begin to play my game in return, and I assure you they aint gonna like my game any better than I like theirs. All is fair in love and war.
Protect your rights----fight for them. The N.C. helmet law as it is written--is unconstitutional which means it is a void law and unenforceable. Take em to court and fight to repeal this law. You guys have a great one---see you on the road. Ron
