Alright guys--just found out about my other ballcap helmet ticket I have been fighting in court. To refresh your memory--I got this ticket back in August, was found guilty by trial in District Court from a judge who wouldn't even allow me to question the prosecutions witness (the cop) on stand. Judge stated to me when he found out I was bringing up unconstitutional laws that I was just trying to "Pull a fast one past him and he wasn't gonna be having any of that." So--off to Superior Court I appealed it..I've been there a few times for the same ballcap helmet on a previous ticket that was dismissed. And--after the DA's office finally got tired behaving like children with this ticket now, giving me the run around because they know they can't win this case in court,, and they just don;'t wanna look like the fools that they are and lose the case--they finally dismissed this ticket ,Stating "Not in the interest of the Superior Court for the State to prosecute." Hmm--think it may have had something to do with Judge Winner telling them I had a excellent case and he would like to hear my trial because he thought our legislators had made the law unconstitutional by the wording of the law. Of course--after the DA's office heard this--did they present my case to this judge? NO WAY!! Chicken Shits. Yeah--that would be you Nathan and Elizabeth, both Assistant DA's whom I am told check out these open BOLT sites often. I win--and you lose--again! Don't that just chap your ass? I may not have gotten my day in court--but I cost you guys a ton of time and money and I never paid a penny. We gonna repeal this law....BOLT will do it. Why drag out the inevitable? Just want to let you know---I'll be seing you in court again--this time with a plan that will ensure me getting to see a judge and a jury of 12 peers.
Keep up the pressure fellow bikers and riders. Don't bend over to this law---it's illegal- and can be beat. Later.

What you need to do now is find out how much tax payers money was wasted on this ticket and let the taxpayers see what our elective officials are doing with their hard earned money.

The Money
You can use my estimate of over $8000 to try and prosecute one $25 fine that I didn't have to pay. That begins with the NC court systems' own estimate of district court costs for every ticket that is a not guilty plea, $853, if I remember correctly. Add on the travel expenses to get Trooper Kendall Jackson back and forth to Raleigh when gasoline jumped up to $4.39 per gallon. Add all the other court costs, and taking my $25 helmet ticket to a Superior Court trial is estimated to have cost the taxpayers over $8000, and that doesn't include the pain in the butt it MUST be for the courts to try a helmet ticket over the course of two days while there are murderers, rapists, thieves, corrupt politicians and their assistants waiting.

So, here's the score, so far, to the best of my knowledge, of the few NC ticket trials that were contested to the trial courts in the last two years, NONE OF THOSE WHO USED THE JUDICIAL PROCESS HAVE PAID ONE RED CENT IN FINES AND FEES!
Only ONE case has been allowed to actually go to trial in Superior Court since January 1, 2008 when the new statute, (resulting from H563 introduced by Sutton), went into effect. I'll bet they've reviewed transcripts, found out the trial court erred, saw we are citing good case law, and they know they'll lose if well-prepared people get this as far as the appellate courts.
